These Terms and Conditions govern the tours and services provided by Two Sea Tour, a brand operated by Simba Sea Trips Co., Ltd (TAT Licence No. 34/02111), of Soho Pool Club, Boat Lagoon Marina, Moo 2, Ko Kaeo, Ampur Mueang, Phuket 83000, Thailand ("we", "us", "our"). By making a booking with us you agree to these terms. Please read them carefully.
Bookings and payment
A booking is confirmed once you have paid either the full tour price or a deposit through our booking system. All prices are quoted in the currency shown at checkout and are all-inclusive: they cover Thai VAT, booking and processing fees, national park fees where applicable, insurance for eligible passengers, hotel transfers within Phuket, food and non-alcoholic drinks as described on each tour, and the equipment needed for the day. Where you pay a deposit, the outstanding balance is due on the day of your tour and may be settled when you arrive at our base at Boat Lagoon Marina.
Cancellations and refunds
Cancellations, refunds, weather cancellations and rescheduling are governed by our
Cancellation Policy, which forms part of these terms. In short: free cancellation up to 24 hours before departure; cancellations within 24 hours are non-refundable; and if we cancel for weather or safety you receive a full refund or a free reschedule.
Your tour, safety and the captain's authority
Your safety is our first priority. The captain and crew have full authority over the vessel and the running of the day, including any decision to change the itinerary, alter the route, or cancel a departure where weather, sea conditions or safety require it. Itineraries are a guide and may be adjusted on the day for conditions beyond our control such as weather, tides, national park access or the number of vessels at a site.
Your responsibilities
You agree to follow the reasonable instructions of the crew at all times, and to inform us before booking of any medical condition, disability, pregnancy, or dietary requirement relevant to your participation. You are responsible for ensuring that you and anyone in your party are fit to take part in the activities booked. Life jackets are provided and must be worn as directed. We reserve the right to refuse participation, without refund, to any guest who is intoxicated, behaves unsafely, or puts themselves or others at risk.
Children
Children are welcome on our tours accompanied by a responsible adult, who remains responsible for their supervision throughout the day. Life jackets and equipment are provided in children's sizes.
Hotel transfers
Included hotel transfers cover locations within Phuket. Pickup times are confirmed by email the evening before your departure. Please be ready at the agreed time and place; we cannot delay a departure for late guests, and missed pickups due to guest delay are treated as a late cancellation.
Photography and media
We may take photographs or video during tours for our own promotional use. If you would prefer not to appear in such material, please let a crew member know on the day and we will do our best to accommodate your request.
Liability
We operate our tours with care and in accordance with our TAT licence and applicable Thai regulations, and eligible passengers are insured as described in each tour. To the fullest extent permitted by law, we are not liable for loss, damage, injury or delay arising from circumstances beyond our reasonable control, or from a guest's failure to follow crew instructions or to disclose a relevant medical condition. Nothing in these terms limits any liability that cannot be limited under applicable law.
Personal belongings
Personal belongings brought on tour remain your responsibility. We recommend leaving valuables behind and bringing only what you need for the day.
Privacy
Personal data you provide is handled in accordance with our
Privacy Policy.
Governing law
These terms are governed by the laws of Thailand, and any dispute arising from them is subject to the jurisdiction of the Thai courts.
